178 Section 301 exclusions on Chinese goods expire on 9 November 2026: are your goods affected? in detail
USTR extended 178 Section 301 exclusions on Chinese goods through 11:59 p.m. eastern time on 9 November 2026, for goods entered for consumption or withdrawn from warehouse on or after 30 November 2025 (Federal Register doc. 2025-21671). The exclusions use two HTSUS headings: 9903.88.69 and 9903.88.70. Unless extended again, the Section 301 duty that the exclusion removed applies again under the heading for the product's original list. To check, ask your customs broker whether your entry summaries use either heading. As of this page's check date we found no official notice of a further extension.
- Applies to
- US importers buying from China who may use a Section 301 exclusion, and Chinese factories supplying them.
Dear friend,
Welcome! This letter sets out what you need to know, plainly and in order.
What the notice says (Federal Register doc. 2025-21671, published 1 Dec 2025)
| Question | Text |
|---|---|
| How many | "extend the 178 current exclusions" |
| Until when | Annexes A and B: goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. EST on 30 Nov 2025 and before 11:59 p.m. EDT on 9 Nov 2026. The body text also says "until November 10, 2026"; the annex dates are the safer reading |
| Which headings | Annex A: all exclusions under 9903.88.69; Annex B: all exclusions under 9903.88.70 |
| Further extension | USTR "may continue to consider further extensions and/or additional modifications as appropriate"; no commitment |

How to check
- Ask your broker for recent entry summaries (CBP Form 7501) and look at the Chapter 99 headings on each line.
- A line with 9903.88.69 or 9903.88.70 used an exclusion. Compare the product description with the annex to confirm it is the same product.
- Ask your broker which Chapter 99 heading and rate will apply to the same goods after 9 November 2026. Rates are in the China Tariffs file on
hts.usitc.gov; see how to look up HTS codes and rates.
- Build the difference into prices: cost shipments arriving before and after 9 November separately; what counts is the US entry date, not the ship date.
When to use a licensed professional
- If you are unsure whether a product matches an exclusion description, get written confirmation from a licensed US customs broker.
- For extra duty or corrections on entries already filed, use a broker or a US trade lawyer.
Check before you pay, and warning signs
- Refuse anyone offering to "change the code so the exclusion still applies". Classification follows the actual product; misdeclaration carries penalties.
- Claims that "the exclusions will surely be extended" have no official basis.
Unknowns
- Whether the exclusions will be extended after 9 November 2026: as of 28 October 2026 we found no new official notice. Check the
USTR exclusions page around the expiry date.
- The exact rate after expiry: the notice does not say. The common figures "25% for Lists 1–3, 7.5% for List 4A" were not confirmed from official text here, and some rates were raised after the 2024 review; check by HTS code.
